1. Introduction

Welcome to SmartCarePlus, a healthcare management and automation platform operated by Smart Code Junction Infinity Private Limited (“Company”, “we”, “our”, or “us”), registered under the Ministry of Corporate Affairs, Government of India (CIN: U62099UP2025PTC230480).

These Terms and Conditions (“Terms”) govern your access to and use of SmartCarePlus, including any web applications, APIs, mobile interfaces, WhatsApp integrations, and related services (collectively, “Services”).

By using SmartCarePlus, you (“User”) agree to these Terms. If you are using SmartCarePlus on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Scope of Users

SmartCarePlus supports multiple healthcare participants:

Patients: Individuals using SmartCarePlus for appointments, prescriptions, or health tracking.
Clinics & Hospitals: Facilities managing appointments, staff, and patient records.
Doctors & Radiologists: Medical professionals using SmartCarePlus for consultation and diagnostics.
Labs: Entities uploading and managing diagnostic test reports.
Pharmacies: Stores fulfilling medicine orders and managing stock.

Future categories (e.g., insurers, wellness providers) will also be governed by these Terms once onboarded.

3. Acceptance of Terms

By accessing or using SmartCarePlus:

You confirm you have read, understood, and agree to these Terms.
You consent to our Privacy Policy and related documents.
If you do not agree, do not use SmartCarePlus.

4. Account Registration

Users must provide accurate, complete, and current information during registration.
Each account is linked to a verified email or WhatsApp number.
Users are responsible for maintaining confidentiality of their credentials.
SmartCarePlus reserves the right to suspend or terminate accounts for misuse or fraudulent activity.

5. Services and Responsibilities

5.1 For Patients

You may use SmartCarePlus to manage appointments, store health data, and communicate with healthcare providers.
You are responsible for ensuring your health data is accurate and updated.
You may upload health records, but you grant the Company permission to process them securely as per our Privacy Policy.
You may share your records with healthcare providers using secure share links or export features.

5.2 For Clinics, Doctors, Labs, and Pharmacies

You agree to use SmartCarePlus solely for lawful healthcare operations.
You must comply with all applicable data protection and medical record retention laws.
You are responsible for obtaining valid patient consent before uploading or processing any personal or medical data.
You acknowledge that SmartCarePlus acts as a data processor and does not claim ownership of your data.
You must not use SmartCarePlus to send unsolicited messages or false medical information.

5.3 For Radiologists

You may upload and manage imaging files (DICOM, X-Ray, MRI).
You are responsible for ensuring imaging data does not contain unnecessary personal identifiers beyond required medical metadata.

6. Use of WhatsApp & Communication Tools

WhatsApp notifications, reminders, and updates are sent via Meta’s Cloud API.
By enabling WhatsApp communication, you consent to receive reminders, updates, or promotional messages per your opt-in preference.
Patients may withdraw consent anytime through settings or by contacting support.
Clinics and providers must ensure patients have granted communication consent before enabling automated reminders.

7. Payments and Billing

All payments are processed securely through Razorpay.
SmartCarePlus does not store any payment credentials (card, UPI, or bank data).
Subscription and billing plans are listed on the SmartCarePlus website.
Refunds are handled as per our Refund Policy.
Invoices are generated and hosted by SmartCarePlus but transactions occur via Razorpay’s secure platform.
By subscribing, you authorize recurring payments where applicable until cancellation.

8. Data Protection and Privacy

All data processing follows our Privacy Policy.
SmartCarePlus complies with Indian IT (SPDI) Rules and DPDP Act (2023).
Sensitive health data is encrypted, access-controlled, and stored regionally.
Users retain ownership of their uploaded health data.

9. Prohibited Uses

You must not:

Use SmartCarePlus for spam, phishing, or unauthorized access.
Misrepresent patient data or impersonate medical professionals.
Upload harmful code, viruses, or scripts.
Share login credentials or access tokens.
Reverse engineer, copy, or resell any part of SmartCarePlus without written consent.
Use the platform for illegal or non-medical purposes.

Violation may result in account suspension and legal action.

10. Data Retention and Termination

SmartCarePlus retains data for 7 years or as required by law.
Upon termination, you may request data export or deletion within 30 days.
Certain anonymized data may be retained for analytics or legal compliance.
SmartCarePlus may terminate access for inactivity, breach of terms, or non-payment.

11. Intellectual Property

All software, design, trademarks, and content on SmartCarePlus are owned by Smart Code Junction Infinity Pvt. Ltd.
Users retain ownership of their data but grant SmartCarePlus a limited license to process it for service delivery.
You may not copy, redistribute, or commercially exploit SmartCarePlus content.

12. Service Availability

SmartCarePlus strives for 99.9% uptime, but services may experience interruptions due to maintenance or external factors.
SmartCarePlus is not liable for temporary unavailability, data loss due to third-party outages, or force majeure events.

13. Limitation of Liability

SmartCarePlus is a software platform, not a healthcare provider.
We do not provide medical advice, diagnosis, or treatment.
The Company is not liable for any direct or indirect damages arising from:
- Misuse of data by healthcare providers,
- Technical issues beyond our control,
- Errors in user-uploaded content, or
- Medical decisions based on SmartCarePlus data.
Total liability shall not exceed the subscription fee paid for the preceding 3 months.

14. Compliance and Legal Requirements

Users must comply with applicable national and international healthcare regulations.
SmartCarePlus may disclose data if legally required by a government or court order.
Cross-border data transfers comply with contractual clauses ensuring equal protection.

15. Indemnification

You agree to indemnify and hold harmless Smart Code Junction Infinity Pvt. Ltd., its directors, employees, and partners from any claims, damages, or expenses arising from:

Your misuse of SmartCarePlus,
Your breach of these Terms, or
Any data, content, or material uploaded by you.

16. Suspension and Termination

SmartCarePlus may suspend or terminate your account if:

You violate these Terms or applicable laws.
You engage in unauthorized access or misuse of the platform.
Payment is overdue beyond 30 days. Upon termination, your data will be handled per our Privacy Policy.

17. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of India, with jurisdiction in Uttar Pradesh. Any dispute will be first attempted to be resolved amicably. If unresolved, it shall be subject to arbitration under the Arbitration and Conciliation Act, 1996, with venue in Ballia, India.

18. Modifications to Terms

SmartCarePlus may update these Terms periodically. Continued use of the platform after updates implies acceptance of the revised Terms. The “Last Updated” date at the top reflects the most recent version.

19. Grievance Officer

As required under Rule 5 of the IT (SPDI) Rules 2011, we have appointed a Grievance Officer to address your concerns and complaints.
